Terms and Conditions for GA4 AI Insights Tool

1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the GA4 Insights Generator service, including any related applications and services (collectively, the “Service”), provided by Dreamnotion Innovations LLP (“we,” “us,” “our”) through the thrivemattic.com website.

    • The license is non-transferable without our prior written permission

    • You may not redistribute, sell, lease, or provide access to the Service code
    • You may not reverse engineer, decompile, or attempt to extract the source code

4. User Obligations

    You agree to:

    • Keep your account information updated
    • Protect your account credentials
    • Accept responsibility for all activities that occur under your account

  • 4.2 Google Analytics Access

    You agree to:

    • Secure your Google Analytics credentials
    • Comply with Google’s Terms of Service
    • Grant appropriate access permissions to the Service
    • Use the Service only with Google Analytics accounts you own or have permission to access

  • 4.3 Compliance with Laws

    You agree to use the Service in compliance with all applicable laws and regulations, including data protection and privacy laws.

5. Service Description and Availability

    The Service provides AI-powered insights generated from Google Analytics 4 data, delivered through reports and email notifications based on your Subscription plan.

  • 5.2 Service Availability

    • We target 99.9% uptime for the Service
    • We may conduct scheduled maintenance with advance notice
    • We do not guarantee uninterrupted access to the Service
    • We reserve the right to modify features with reasonable notice

  • 5.3 Support

    Support availability depends on your Subscription plan:

    • Free Plan: Basic email support
    • Paid Plan: Priority email support
    • Enterprise Plans: Custom support arrangements

6. Data Usage and Security

  • 6.1 Data Collection and Processing

    • We collect and process data as described in our Privacy Policy.
    • We only access Google Analytics data with your explicit permission.
    • We use industry-standard security measures to protect your data.

  • 6.2 Data Ownership

7. Account Termination

10. Limitation of Liability

    IN NO EVENT SHALL OUR LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PREVIOUS 12 MONTHS.

    We assume no responsibility for any third-party services you access through the Service, including Google Analytics.

  • 10.4 Force Majeure

    We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to, acts of God, war, terrorism, riots, embargoes, internet disruptions, or any other force majeure event.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dreamnotion Innovations LLP, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

  • 12.2 Dispute Resolution

    Any dispute arising out of or in connection with these Terms shall be resolved through the following mechanisms:

    • Amicable resolution through our customer support
    • Formal grievance redressal through our designated Grievance Officer
    • For Indian consumers, disputes may be addressed through Consumer Courts as per the Consumer Protection Act, 2019
    • Mediation or arbitration in Bangalore, Karnataka, India
    • Legal proceedings in the courts of Bangalore, Karnataka, India, which shall have exclusive jurisdiction

13. Miscellaneous Provisions

  • 13.1 Entire Agreement

    These Terms constitute the entire agreement between you and us regarding the Service, superseding any prior agreements.

  • 13.2 Severability

    If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • 13.3 No Waiver

    Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

  • 13.4 Assignment

    We may assign our rights and obligations under these Terms. You may not assign your rights or obligations without our prior written consent.
